Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and ListingComet (“ListingComet”, “we”, “us” or “our”) and govern your access to and use of the ListingComet website, application and related services (collectively, the “Services”). By creating an account, accessing the Services, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, you must not use the Services.

3. Accounts and account security
You are responsible for all activity occurring under your account, whether or not authorised by you. You must keep your sign-in credentials confidential and notify us promptly at support@listingcomet.com if you become aware of any unauthorised use.
Accounts are for the use of a single account holder and may not be shared, sold, transferred or sublicensed. We are not liable for any loss arising from your failure to safeguard your credentials.
4. Plans, allowances and free access
The Services are offered on a free plan and on paid subscription plans. Allowances are expressed as a number of Etsy listings. The free plan includes a one-time allowance which does not renew. Paid plans include the allowances described on our pricing page at the time of purchase.
One listing is consumed when the Services complete the research and copy for a listing. Publishing that listing to Etsy, scheduling it, editing it, and making later changes to it do not consume any further allowance, and returning to the same listing to revise it again does not consume a further listing. Allowances are not transferable between accounts, refundable for cash, or carried over between billing periods except where we expressly state otherwise. We may modify, limit or withdraw free access at any time.
5. Billing and automatic renewal
Paid subscriptions are billed in advance on a monthly or yearly basis, as selected at checkout, and renew automatically at the then-current price for successive periods of the same length until cancelled. By subscribing you authorise us and our payment processor to charge your payment method on each renewal date.
Payment processing is performed by Stripe. We do not receive or store your full card details. You are responsible for keeping a valid payment method on file; if a charge fails, we may retry it, suspend access to paid features, or terminate the subscription, and you remain liable for amounts properly due.

Except as set out in this section or as required by law, fees are non-refundable and payments already made are not refunded on cancellation, downgrade, non-use of the Services, or termination for breach.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that applies to you under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where such a guarantee applies and we have failed to meet it, you are entitled to the remedies that law provides, and §§18 to 20 apply only to the extent that law permits.
We may, at our discretion, grant a refund in circumstances we consider appropriate. Doing so once does not oblige us to do so again.
10. Acceptable use and restrictions
You must not, and must not permit any other person to:
- copy, modify, translate, reverse engineer, decompile, or attempt to derive the source code of the Services, except to the extent this restriction is prohibited by law;
- resell, sublicense, rent, white-label or otherwise make the Services available to any third party without our prior written agreement;
- scrape, crawl, harvest, or use automated means to extract data from the Services, or circumvent any rate limit, access restriction or security measure;
- use the Services to generate or publish content that infringes the intellectual property, privacy or other rights of any person, or that is unlawful, deceptive or misleading;
- list or promote products you do not have the right to sell, or use the Services in breach of Etsy’s terms, policies or seller standards;
- impose an unreasonable load on the Services or on any third-party service accessed through them, or interfere with their operation or integrity;
- access another user’s account or data, or misrepresent your identity or affiliation.
We may investigate suspected breaches and take any action we consider appropriate, including suspension or termination under §21 and reporting unlawful conduct to the relevant authorities.
11. Your content
You retain all ownership of the photographs, videos, files, product details and other material you provide (“Your Content”), and of the listing content generated for you through the Services.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, adapt and process Your Content solely to the extent necessary to operate and provide the Services to you, including transmitting it to the third-party services described in §14 and to Etsy at your direction. This licence ends when Your Content is deleted, save for copies retained as described in §17.
You represent and warrant that you hold all rights necessary to grant this licence and that Your Content does not infringe the rights of any person.

The Services depend on third parties we do not control, including Etsy, our artificial intelligence provider, and our hosting, storage, payment and email providers. Their availability, terms and pricing may change, and parts of the Services may be affected or unavailable as a result. We are not responsible for third-party services, their content, their acts or omissions, or their handling of data once it is in their control.
Your relationship with Etsy is governed by your agreements with Etsy. You are responsible for complying with them, and for the content of every listing you publish, whether or not it was generated using the Services. Connecting a shop authorises us to act on that shop through Etsy’s API at your direction; you may revoke that authorisation at any time by disconnecting the shop in your settings or through your Etsy account.
The term “Etsy” is a trademark of Etsy, Inc. This Application uses Etsy’s API, but is not endorsed or certified by Etsy.
15. Artificial intelligence and generated content
Listing content produced by the Services is generated by artificial intelligence models and may be inaccurate, incomplete, misleading, non-original or otherwise unsuitable. It is a draft for your review, not professional, legal, commercial or marketing advice.
You are solely responsible for reviewing, correcting and approving all generated content before it is published, and for ensuring it accurately describes your products and complies with Etsy’s policies and all applicable law. We make no representation or warranty that generated content is accurate, original, non-infringing, or fit for any purpose, and we assume no responsibility for content you choose to publish.
16. No guarantee of results
17. Data storage, retention and deletion
Your data is stored with our infrastructure providers on servers that may be located outside your country of residence, including in the United States. By using the Services you consent to that storage and transfer. Where data protection laws differ between jurisdictions, protections available to you may differ from those in your own.
We retain your data for as long as your account is open and for as long afterwards as is reasonably necessary to provide the Services, comply with our legal obligations, resolve disputes and enforce our agreements. To request deletion of your account and its data, email support@listingcomet.com; we will action the request and confirm when it is complete. Deletion is permanent and deleted data cannot be recovered. Listings already published to your Etsy shop are unaffected — they belong to your shop, not to us.
We may delete accounts that have been inactive for twelve months or more, after attempting to notify you at your registered email address.
18. Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement.
We do not warrant that the Services will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that any information or data provided through the Services — including marketplace research data, competition estimates and pricing suggestions, regardless of source — is accurate, complete, reliable, current or error-free. Marketplace data is obtained from third parties, is subject to their limitations, and may be out of date at the time you see it.
Disclaimer: this Application is solely provided by ListingComet (the “Application Developer”). You acknowledge that Etsy, Inc. and its affiliates are not the Application Developer, do not provide the Application service, and make no warranties of any kind with respect to the Application or data accessed through it.
19. Limitation of liability
To the maximum extent permitted by law, ListingComet will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, sales, goodwill, data or business opportunity, arising out of or in connection with these Terms or the Services, whether in contract, tort (including negligence), statute or otherwise, and whether or not we were advised of the possibility of such loss.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these Terms or the Services is limited to the total amount you paid us for the Services in the three months immediately preceding the event giving rise to the claim.
These limits apply subject to §9, and do not limit any liability that cannot lawfully be limited.
20. Indemnity
21. Suspension and termination
You may stop using the Services and request deletion of your account at any time under §17. We may suspend or terminate your access to the Services, in whole or in part, with or without notice, if you breach these Terms, if we are required to do so by law or by a third party on which the Services depend, if your account is used in a manner that risks harm to us, to other users or to any third-party platform, or if we discontinue the Services.
Where we terminate without cause, we will refund the unused portion of any prepaid fee for the period after termination. Where we terminate for your breach, no refund is payable except as required by law.
